Terms and Conditions

1. Introduction

Welcome to MeloLingo: Spanish with Music ("we," "our," or "us"). By downloading, installing, accessing, or using our mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and MeloLingo regarding your use of the App.

2. License Grant & Restrictions

2.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App specifically for your personal, non-commercial language learning purposes.

2.2 Restrictions

You explicitly agree NOT to:

• Reverse Engineer: Decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the App.
• Scrape or Extract Content: Use any automated means (such as bots, spiders, or scrapers) or manual methods to extract, copy, or "scrape" any music, lyrics, translations, educational content, or audio files from the App.
• Commercial Use: Rent, lease, lend, sell, redistribute, or sublicense the App or its content.
• Modify: Copy, modify, or create derivative works of the App or its content.

3. Account Registration

To access certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

4. Purchases and Legacy Existing Subscriptions

Current offer: the App is free to download, with full lifetime Premium access available as an optional one-time in-app purchase. One-time payment. No subscription.

4.1 Management by App Stores

Purchases are managed directly by Apple (App Store) or Google (Play Store), depending on your device. We do not directly process your credit card information or handle your payments. All billing, taxes, and transaction references are handled by the respective App Store.

4.2 Lifetime Purchase

The current lifetime Premium purchase is non-consumable and does not automatically renew. Access can be restored through the store account used for the original purchase, subject to Apple's or Google's applicable terms.

4.3 Legacy Existing Subscriptions

Some existing customers may retain a legacy existing subscription purchased before the current lifetime-first offer. We continue to honor access and store-managed rights for those customers. A legacy existing subscription may renew under the store terms accepted when it was purchased until the customer cancels it; it is not the current offer for new customers.

4.4 Canceling a Legacy Existing Subscription

A customer with a legacy existing subscription may cancel it at any time. Uninstalling or deleting the App does NOT cancel a legacy existing subscription. It must be canceled through the applicable device settings:

• For a legacy existing subscription on iOS: Go to your device's "Settings" > Tap your name/Apple ID > Tap "Subscriptions" > Select "MeloLingo" > Tap "Cancel Subscription."
• For a legacy existing subscription on Android: Open the Google Play Store > Tap your profile icon > Tap "Payments & subscriptions" > Tap "Subscriptions" > Select "MeloLingo" > Tap "Cancel subscription."

4.5 Refunds

Because payments are processed by Apple and Google, we generally cannot issue refunds directly.

• iOS Refunds: You must request a refund directly from Apple via reportaproblem.apple.com. Apple handles these requests at their sole discretion.
• Android Refunds: You may request a refund via the Google Play Store or contact Google Support.

4.6 Price Changes

We reserve the right to modify pricing for future purchases. Any price change to a legacy existing subscription will be communicated by the App Store or Play Store under its applicable terms, including any required opportunity to cancel before the new price takes effect.

5. Intellectual Property Rights

5.1 Ownership

The App, including but not limited to all music, audio recordings, lyrics, translations, text, graphics, user interfaces, scripts, and software code, is the property of MeloLingo or its licensors and is protected by copyright, trademark, and other intellectual property laws.

5.2 User-Generated Content

If the App allows you to post or track progress (such as learning stats), you retain ownership of your personal data, but you grant us a license to use this data to provide and improve the App's services.

6. Disclaimers & No Guarantees

6.1 "As Is" Basis

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no representations or warranties of any kind, express or implied, regarding the operation of the App or the information, content, or materials included.

6.2 Language Learning Results

We do not guarantee that you will achieve a specific level of fluency or any particular language learning result from using the App. Learning pace and retention vary significantly between individuals.

7. Limitation of Liability

To the fullest extent permitted by law, MeloLingo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the App;
• Any unauthorized access to our servers or content;
• Any bugs, viruses, or the like that may be transmitted to or through our App by any third party.

8. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
