1. Introduction
Welcome to TurtleTune: Spanish with Music ("we," "our," or "us"). By downloading, installing, accessing, or using our mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms constitute a legally binding agreement between you and Turtle Tune regarding your use of the App.
2. License Grant & Restrictions
2.1 License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App specifically for your personal, non-commercial language learning purposes.
2.2 Restrictions
You explicitly agree NOT to:
- Reverse Engineer: Decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the App.
- Scrape or Extract Content: Use any automated means (such as bots, spiders, or scrapers) or manual methods to extract, copy, or "scrape" any music, lyrics, translations, educational content, or audio files from the App.
- Commercial Use: Rent, lease, lend, sell, redistribute, or sublicense the App or its content.
- Modify: Copy, modify, or create derivative works of the App or its content.
3. Account Registration
To access certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your account credentials and for all activities that occur under your account.
4. Subscriptions and Billing
The App offers a premium subscription service ("Premium") that grants access to our full library of songs, lyrics, and learning features.
4.1 Management by App Stores
Our subscriptions are managed directly by Apple (App Store) or Google (Play Store), depending on your device. We do not directly process your credit card information or handle your payments. All billing, taxes, and transaction references are handled by the respective App Store.
4.2 Auto-Renewal
Subscriptions automatically renew. Unless you cancel your subscription at least 24 hours before the end of the current subscription period, your payment method will be charged for the next period. The cost of the renewal will match your initial subscription price unless otherwise notified.
4.3 Cancellation
You may cancel your subscription at any time. Uninstalling or deleting the App does NOT cancel your subscription. You must cancel through your device settings:
- iOS Users: Go to your device's "Settings" > Tap your name/Apple ID > Tap "Subscriptions" > Select "Turtle Tune" > Tap "Cancel Subscription."
- Android Users: Open the Google Play Store > Tap your profile icon > Tap "Payments & subscriptions" > Tap "Subscriptions" > Select "Turtle Tune" > Tap "Cancel subscription."
4.4 Free Trials
We may offer a free trial period for new users. If you do not cancel at least 24 hours before the free trial ends, you will automatically be charged for the subscription price selected when you started the trial. Any unused portion of a free trial will be forfeited if you purchase a subscription during the trial period.
4.5 Refunds
Because payments are processed by Apple and Google, we generally cannot issue refunds directly.
- iOS Refunds: You must request a refund directly from Apple via reportaproblem.apple.com. Apple handles these requests at their sole discretion.
- Android Refunds: You may request a refund via the Google Play Store or contact Google Support.
4.6 Price Changes
We reserve the right to modify our pricing at any time. Any price changes will be communicated to you in advance by the App Store or Play Store, and you will have the opportunity to cancel before the new price takes effect.
5. Intellectual Property Rights
5.1 Ownership
The App, including but not limited to all music, audio recordings, lyrics, translations, text, graphics, user interfaces, scripts, and software code, is the property of Turtle Tune or its licensors and is protected by copyright, trademark, and other intellectual property laws.
5.2 User-Generated Content
If the App allows you to post or track progress (such as learning stats), you retain ownership of your personal data, but you grant us a license to use this data to provide and improve the App's services.
6. Disclaimers & No Guarantees
6.1 "As Is" Basis
The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no representations or warranties of any kind, express or implied, regarding the operation of the App or the information, content, or materials included.
6.2 Language Learning Results
We do not guarantee that you will achieve a specific level of fluency or any particular language learning result from using the App. Learning pace and retention vary significantly between individuals.
7. Limitation of Liability
To the fullest extent permitted by law, Turtle Tune shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the App;
- Any unauthorized access to our servers or content;
- Any bugs, viruses, or the like that may be transmitted to or through our App by any third party.
8. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
